CASH BOXX

A Digital Lending Platform of Barwala Leasing and Finance Private Limited.

RBI-Registered Non-Banking Financial Company

These Terms and Conditions (“Terms”) set out a legally enforceable arrangement between you (“Applicant”, “You”, “Your”) and Barwala Leasing and Finance Private Limited (“BLF”, “the Company”, “the Lender”), a Non-Banking Financial Company registered with the Reserve Bank of India and incorporated under the Companies Act, which runs its digital lending business under the brand name Cash Boxx. These Terms apply to your use of the Cash Boxx website, mobile application, and every associated digital service (together, the “Platform”), and to the process of applying for and receiving credit facilities made available through the Platform.

By opening the Platform, creating a profile, or submitting a loan application, you confirm that you have read and understood these Terms and that you unconditionally accept them, together with the Privacy Policy and any other policy that Cash Boxx publishes and updates from time to time. IF YOU DO NOT ACCEPT THESE TERMS, IN WHOLE OR IN PART, YOU MUST NOT ACCESS, DOWNLOAD, INSTALL, OR OTHERWISE USE THE PLATFORM.

These Terms must be read together with the Sanction Letter, Key Fact Statement (KFS), Loan Agreement, and Privacy Policy issued to you, each of which forms part of the complete contractual arrangement between you and Cash Boxx/BLF.

1. What Cash Boxx Is

Cash Boxx is the digital lending brand and platform owned and operated by Barwala Leasing and Finance Private Limited, a Non-Banking Financial Company registered with the Reserve Bank of India. Every loan offered, evaluated, sanctioned, and disbursed through the Platform is originated by BLF, and every credit decision rests exclusively with BLF.

The Platform exists to give eligible individuals in India a fast, paperless way to borrow money. Through it, you can submit an application, finish your KYC, review a loan offer, digitally execute the loan documents, and keep track of your account, all from your phone or computer.

The “Cash Boxx” name, its logo, and every trademark, service mark, or other intellectual property connected with it belong solely to BLF. Copying, imitating, or otherwise making unauthorised use of the Cash Boxx brand may attract legal proceedings.

Filling in and submitting an application does not by itself result in a loan being sanctioned. BLF alone decides, at its full discretion and in line with RBI directions and other applicable law, whether to approve, reject, modify, or cancel an application, and it decides the amount, tenure, rate of interest, and other terms that apply. Unless the law requires otherwise, BLF is not obliged to explain why an application has been turned down.

2. Who Can Use Cash Boxx

To register on Cash Boxx and apply for a loan, you need to meet every one of the following conditions:

1. you are an Indian citizen;
2. you are a natural person, at least 18 years old, and legally capable of entering into a binding contract under Indian law;
3. you are solvent, and no insolvency, bankruptcy, or debt-restructuring proceeding is pending against you;
4. you hold a valid bank account and an active mobile number, and you can furnish a valid PAN and other KYC documents as prescribed by RBI;
5. you have not been declared a willful defaulter and are not subject to any adverse direction from RBI, SEBI, or any other regulator;
6. everything you state in the application form, in these Terms, and in the Loan Agreement is, and will remain, true, accurate, and complete for the entire duration of the loan; and
7. you have satisfied every condition precedent that Cash Boxx may specify, to BLF’s satisfaction.

Cash Boxx can check your eligibility at any point and can suspend, close, or reject your account or application if any of the above conditions is not met, is found to be false, or ceases to apply. Accessing the Platform through bots, scripts, or any other automated, non-human means is not allowed.

3. Setting Up and Protecting Your Account

To apply for a loan on the Platform, you first register using your mobile number and complete verification through an OTP or any other authentication method Cash Boxx adopts in line with applicable law.

Once you set up an account, you agree that:

1. the details you give, at registration and afterwards, will be accurate, complete, and current;
2. you will hold only one account on the Platform, and you will not open a second one;
3. you alone are answerable for whatever happens under your account, including every application filed and every transaction carried out;
4. you will keep your login details, OTP, PIN, and password to yourself and will not pass them on to anyone else; and
5. you will tell Cash Boxx right away, at care@cashboxx.in, if you notice any unauthorised use of your account.

Cash Boxx will not answer for any loss you suffer because you failed to protect your account credentials or because someone misused your account owing to your own carelessness or a breach of these Terms.

Cash Boxx can suspend or close your account at any time, with or without advance notice, if it has reason to think the information you gave is false, incomplete, or misleading, or if you have broken these Terms or any law.

4. Applying for a Loan and How It Is Assessed

Through Cash Boxx you can put in a loan application for BLF to review. When you submit one, you allow Cash Boxx, along with its staff, agents, representatives, service providers, and authorized third parties, to:

1. run credit checks, contact your references, and make any other enquiry reasonably needed to process your application;
2. gather, verify, use, and pass on information to and from any statutory body, credit bureau, bank, financial institution, the Central KYC Registry, verification agency, account aggregator, or any other authorized party, for underwriting, risk evaluation, and regulatory compliance;
3. carry out KYC through video KYC, e-KYC, Aadhaar-based verification, or any other method permitted by law; and
4. pull your credit report from bureaus such as CIBIL, Experian, CRIF High Mark, and Equifax to work out your creditworthiness.

BLF assesses every application against its own internal credit models, risk framework, and the applicable regulatory guidance. Submitting an application never obliges BLF to sanction the loan, and the final call is entirely BLF’s; no assurance is given that any application will be approved or funds released.

If your application is rejected, Cash Boxx is not required to give reasons unless the law says otherwise.

5. Your Declarations and Obligations

By applying for a loan or using the Platform, you declare and confirm that:

1. everything you have submitted on Cash Boxx or otherwise given to Cash Boxx is true, correct, complete, and current, and you have not left out anything material;
2. you have not hidden, downplayed, or misstated any fact relevant to how your application is assessed;
3. the documents you have submitted are genuine and have not been altered or forged; and
4. you will tell Cash Boxx promptly about any change to your name, address, contact number, job, income, or financial position, or anything else material to the loan, for as long as the loan remains outstanding.

If you misrepresent, hide, or falsify any information, Cash Boxx may reject your application, cancel or recall the loan, and pursue whatever civil, criminal, or regulatory action the law allows.

6. How the Loan May Be Used

You agree that money sanctioned and released under these Terms will not, directly or indirectly, be used for:

1. any unlawful, unauthorized, anti-social, or otherwise prohibited purpose;
2. speculative, fraudulent, or improper activity;
3. any purpose that runs counter to RBI directions or the rules of any other competent regulator; or
4. buying or trading securities, derivatives, or other financial instruments where such dealing is barred by law.

Credit will only be extended where the Reserve Bank of India and other applicable regulators permit it and in the manner they specify. If a loan is cancelled after disbursement, you remain liable to pay proportionate interest, fees, and other dues on the outstanding amount, as set out in the Sanction Letter, KFS, Loan Agreement, and applicable law.

7. How We May Contact You

By registering on and using Cash Boxx, you allow Cash Boxx, its staff, agents, representatives, and authorized service providers, to reach you through:

1. phone calls and other mobile communication; and
2. SMS, WhatsApp, email, push notifications, and other digital channels.

These communications may cover your application, your loan account, your repayment schedule, customer service, collections and recovery, legal or regulatory notices, or promotions and offers, where you have consented to receiving the latter.

By registering your mobile number on the Platform, you allow Cash Boxx to send transactional SMS, OTPs, and service alerts even if your number sits on the Do Not Disturb (DND) or National Customer Preference Register (NCPR) list, to the extent the law allows this.

You can withdraw your consent to promotional messages at any time by writing to care@cashboxx.in. Doing so will not stop transactional, service, legal, or regulatory communications, or any messages needed to administer your loan or enforce Cash Boxx’s rights under the contract.

8. Keeping Your Records

Every document and record you submit through Cash Boxx, including photographs, selfies, video KYC recordings, application forms, declarations, and other electronic records, may be kept by Cash Boxx as required by law, its own internal record-retention rules, and regulatory direction.

Cash Boxx is not obliged to return any such document or record to you, and you give up any claim to their return, subject to whatever statutory rights you may separately hold.

All such data and documents sit on servers based in India, consistent with the data localization requirements under RBI directions and applicable law.

9. Handling Your Personal Data

Personal information and sensitive personal data gathered while you apply for and hold a loan through Cash Boxx is collected, stored, used, disclosed, transferred, and retained in line with applicable law, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and applicable RBI directions.

By using the Platform and submitting an application, you allow Cash Boxx to share your personal data, strictly on a need-to-know basis and for the purposes explained in the Cash Boxx Privacy Policy, with:

1. credit bureaus such as CIBIL, Experian, CRIF High Mark, and Equifax;
2. KYC and identity verification agencies, account aggregators, and payment service providers;
3. technology partners, device intelligence providers, and fraud-detection vendors;
4. collection and recovery agencies engaged by BLF; and
5. statutory authorities, regulators, auditors, and law enforcement, where the law requires it.

Any sharing of your personal data with a third party carries appropriate confidentiality obligations, and, except where sharing is required under a statutory or regulatory mandate or is otherwise allowed by law, Cash Boxx obtains your explicit consent before sharing it.

Your rights over your personal data, including access, correction, withdrawal of consent, and deletion, are set out in full in the Cash Boxx Privacy Policy available at www.cashboxx.in. The Privacy Policy is incorporated into, and forms part of, these Terms.

10. Sharing Information with Regulators and Statutory Bodies

You authorise Cash Boxx to pass on your application form and other relevant documents and information to:

1. the Central Registry and the Central KYC Registry (CKYC);
2. credit information companies and credit bureaus; and
3. the Reserve Bank of India and any other statutory, regulatory, or authorised body, as required or permitted by law.

You also agree to receive information, alerts, and updates from the Central KYC Registry and similar bodies through SMS, email, or other electronic means, at the contact details you have registered.

11. Electronic Records, Signatures, and OTP Authentication

You accept that electronic records, OTP confirmations, digital acceptances, electronic signatures, and electronic authentication carried out through Cash Boxx in relation to any application or loan document are valid, binding, and enforceable to the fullest extent the law allows, including under the Information Technology Act, 2000.

Accepting these Terms, the Loan Agreement, and any related document electronically through Cash Boxx has the same legal effect as signing a physical, written copy.

You alone are responsible for keeping your OTP, PIN, password, and other access credentials confidential, and you must promptly tell Cash Boxx at care@cashboxx.in if you suspect unauthorised access or misuse.

12. KYC and Anti-Money Laundering Compliance

You agree, without objection, to provide the KYC documents, information, and declarations required under RBI directions, the Prevention of Money Laundering Act, 2002, CKYC norms, and any other applicable framework.

You confirm that:

1. the funds you will use to repay the loan come from a lawful, legitimate source;
2. neither you nor any beneficial owner connected to this application is under any sanction, debarment, or adverse order from a competent authority; and
3. every document and piece of information you have given for KYC purposes is genuine and accurate.

Cash Boxx may carry out enhanced due diligence, and may suspend, end, or report any transaction or relationship it suspects involves money laundering, terrorist financing, fraud, or a breach of KYC/AML rules, to the appropriate authorities.

13. What You Must Not Do

Besides the restrictions found elsewhere in these Terms, you agree that you will not:

1. use the Platform for any unlawful, fraudulent, or unauthorized purpose;
2. try to gain unauthorized access to the Platform or any connected system, network, or server;
3. block or hinder any other authorized user of the Platform;
4. copy, alter, distribute, sell, reverse-engineer, scrape, or otherwise commercially exploit Cash Boxx content or technology without BLF’s prior written approval;
5. send any virus, Trojan horse, worm, time bomb, malware, or other harmful code;
6. spam, phish, mine data, scrape, or otherwise automatically gather data from the Platform;
7. submit false, misleading, or made-up information or documents;
8. pretend to be another person or entity, or misstate your identity or affiliation;
9. harass, abuse, defame, or discriminate against anyone; or
10. use the Platform in any way that damages, disables, or impairs it, or interferes with another user’s enjoyment of it.

Cash Boxx can close your account and take whatever legal steps are appropriate if you break any of these restrictions.

14. Your License to Use the Platform

As long as you comply with these Terms, Cash Boxx grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely to apply for a loan and use related services. No other right or license is given, express or implied.

This license does not let you:

1. download, copy, or reproduce Platform content for commercial use;
2. frame or mirror any part of the Platform without prior written permission;
3. use data-mining tools, robots, or similar tools to gather data from the Platform; or
4. resell, sub-license, or otherwise pass on your access to the Platform to anyone else.

Any unauthorized use of the Platform ends this license immediately and may lead to legal action.

15. Intellectual Property

Every piece of content, technology, software, design, interface, brand element, logo, trademark, and other intellectual property on or through the Cash Boxx Platform belongs to BLF and is protected under India’s intellectual property laws.

Nothing in these Terms gives you any licence or right over BLF’s intellectual property, other than the limited access licence described in Section 14 above.

16. Disclaimer and Limits on Liability

The Cash Boxx Platform and everything offered through it are provided on an “as is” and “as available” basis. BLF makes no representation or warranty, express or implied, about how the Platform operates, how accurate or complete its content is, or how continuously available its services will be.

To the fullest extent the law allows, BLF will not be liable for:

1. indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profit, lost data, or lost business opportunity;
2. technical failure, interruption, error, or downtime of the Platform;
3. unauthorized access to your account resulting from your own negligence or failure to protect your credentials;
4. decisions made on information you supplied that later proves inaccurate, incomplete, or false;
5. the acts of third parties, including credit bureaus, regulators, payment service providers, or technology partners; or
6. any loss arising from your use of, or inability to use, the Platform.

BLF’s overall liability for any claim under these Terms will, to the fullest extent the law allows, not exceed any fees you have actually paid to Cash Boxx in connection with the transaction that gave rise to the claim.

Cash Boxx does not promise that the Platform will always be available, error-free, or free of viruses or other harmful elements. You are responsible for putting adequate safeguards on your own devices and systems.

17. Indemnity

You agree to defend, indemnify, and hold harmless BLF, and its officers, directors, employees, agents, representatives, and authorized service providers, against every claim, demand, loss, damage, liability, cost, and expense (including reasonable legal fees) arising from or connected with:

1. your use or misuse of the Platform or any service offered through it;
2. any breach by you of these Terms, the Privacy Policy, or any other applicable policy;
3. any breach of the representations, warranties, or declarations you have made;
4. your infringement of another person’s or entity’s intellectual property or other rights;
5. any false, misleading, or fraudulent information you submit on the Platform; or
6. any breach of applicable law or regulatory requirement.

This indemnity survives the end of these Terms and of your use of the Platform.

18. Links to Other Websites and Services

The Cash Boxx Platform may contain links or redirections to third-party websites, apps, or services, provided purely for your convenience. Cash Boxx does not monitor, endorse, or control the content, privacy practices, or terms of any such third-party platform.

Any dealing you have with a third party reached through the Platform is entirely at your own risk. BLF disclaims all liability for loss or damage arising from your use of third-party websites or your reliance on information found there. You are strongly advised to check the terms and privacy policy of any third-party platform before sharing personal or financial information with it.

19. Promotions and Referral Schemes

Cash Boxx may, from time to time, run promotional offers, referral programmes, or reward schemes to promote the Platform. Every such offer is subject to these Terms and to any additional terms specific to that offer, which will be communicated to you through the Platform.

Cash Boxx can modify, pause, discontinue, or withdraw any promotional offer or reward scheme at any time, at its sole discretion, without prior notice. No promotional offer creates a contractual right to a loan, discount, or other benefit unless expressly stated.

20. Force Majeure

BLF will not be liable for any failure or delay in performing its obligations under these Terms where that failure or delay results from circumstances beyond its reasonable control, including acts of God, natural disaster, pandemic, epidemic, fire, flood, earthquake, war, civil unrest, strike, government or regulatory action, power failure, telecommunications failure, or failure of a third-party service provider.

In such a situation, the affected party will try to resume performance as soon as reasonably possible and will tell the other party about the nature and expected duration of the event.

21. Changes to These Terms

BLF may amend, revise, or update these Terms at any time, subject to applicable law and regulatory requirements. The updated Terms will be published on the Cash Boxx website and mobile application.

If you keep using the Cash Boxx Platform, or submit any application, after revised Terms are published, that counts as your acceptance of the revised Terms. You should check these Terms periodically. Cash Boxx may, though it is not obliged to, let you know about material changes through the Platform or by email.

22. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or connected with them, are governed by and interpreted under the laws of the Republic of India, without regard to conflict of laws principles.

Subject to any mandatory arbitration provisions in the Loan Agreement, the courts of competent jurisdiction at Delhi shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or connected with these Terms.

23. Severability and Waiver

If a court of competent jurisdiction finds any provision of these Terms unlawful, void, invalid, or unenforceable, that provision will be severed from these Terms, and the remaining provisions will continue in full force to the maximum extent the law allows.

BLF’s failure to enforce any right or provision under these Terms is not a waiver of that right or provision, unless an authorized representative of BLF acknowledges and agrees to it in writing.

24. Entire Agreement

These Terms, read together with the Loan Agreement, Key Fact Statement, Sanction Letter, and Privacy Policy applicable to you, form the entire agreement between you and Cash Boxx/BLF on the subject matter covered, and they replace all earlier representations, understandings, or agreements, written or oral, relating to the same subject matter.

25. Grievance Redressal

If you have a complaint, feedback, or concern about the Cash Boxx Platform or any service provided through it, Cash Boxx has set up the following three-level escalation mechanism in line with RBI guidelines:

We aim to acknowledge and respond to every grievance within 48 to 72 hours of receiving it. If you remain unsatisfied with the resolution offered, you may escalate the matter to the Reserve Bank of India’s Integrated Ombudsman Scheme at https://cms.rbi.org.in, or to any other regulatory authority as applicable.

Applicant Declaration

I/We confirm that I/we have read, or have had read out and explained to me/us, these Terms and Conditions, the application form, and the other material made available on the Cash Boxx website and/or mobile application in English and/or Hindi, and that I/we have fully understood their contents. I/We agree to be bound by these Terms and by every applicable policy of Cash Boxx and Barwala Leasing and Finance Private Limited, as amended from time to time. I/We declare that all information I/we have given is true, correct, complete, and current, and I/we accept full responsibility for any consequence arising from any inaccuracy or omission in that information.
